These Terms and Conditions (“Terms”) govern your access to and use of the MYKN mobile applications (Customer App and Delivery Partner App), website, and related services (collectively, the “Platform”).

By accessing or using MYKN, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Definitions

1. “MYKN” refers to the company operating the platform.
2. “Customer” means a user purchasing products through MYKN.
3. “Delivery Partner” means an independent individual delivering orders using the MYKN Delivery Partner App.
4. “Platform” refers to the MYKN apps and website.
5. “Services” include ordering, delivery, payments, and support.

2. Eligibility

1. Users must be 18 years or older to use MYKN services.
2. Delivery Partners must have valid identity documents and licenses (if required).
3. MYKN reserves the right to verify user information at any time.

3. User Accounts

1. Users must provide accurate and complete information.
2. You are responsible for maintaining account confidentiality.
3. MYKN is not responsible for unauthorized account access due to user negligence.
4. One person may maintain only one account unless permitted.

4. Customer Terms

4.1 Orders

1. All orders placed are subject to product availability.
2. Prices, offers, and delivery times may change without prior notice.
3. MYKN reserves the right to cancel orders in case of errors, fraud, or unavailability.

4.2 Payments

1. Payments are processed through secure third-party gateways.
2. MYKN does not store card or UPI details.
3. Refunds, if applicable, will be processed as per refund policy.

5. Delivery Partner Terms

5.1 Independent Contractor

1. Delivery Partners are independent contractors, not employees of MYKN.
2. Delivery Partners are responsible for their own vehicle, fuel, and compliance with traffic laws.

5.2 Location Access

1. Delivery Partner app requires foreground and background location access for order assignment and tracking.
2. Location access is mandatory during active deliveries.

5.3 Conduct

1. Delivery Partners must behave professionally with customers and merchants.
2. MYKN reserves the right to suspend or terminate accounts for misconduct.

6. Cancellations & Refunds

1. Orders can be canceled as per MYKN cancellation policy.
2. Refund eligibility depends on order status and payment method.
3. MYKN reserves final authority on refund decisions.

7. Prohibited Activities

Users must not:

1. Use MYKN for unlawful purposes
2. Provide false information
3. Misuse promotional offers
4. Interfere with platform operations
5. Attempt unauthorized access to MYKN systems

8. Intellectual Property

1. All content, logos, designs, and software belong to MYKN.
2. Users may not copy, distribute, or modify platform content without permission.

9. Account Suspension & Termination

MYKN may suspend or terminate accounts if:

1. Terms are violated
2. Fraudulent or suspicious activity is detected
3. Legal or regulatory requirements demand action

10. Limitation of Liability

MYKN shall not be liable for:

1. Indirect or consequential damages
2. Delivery delays due to external factors
3. Losses caused by third-party service providers

Use of MYKN is at your own risk.

11. Indemnification

You agree to indemnify and hold MYKN harmless from any claims, damages, or liabilities arising from your misuse of the Platform or violation of these Terms.

12. Privacy

Use of MYKN is also governed by our Privacy Policy, which explains how we collect and use personal data.

13. Changes to Terms

MYKN may update these Terms at any time.

Continued use of the Platform indicates acceptance of revised Terms.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of India.

All disputes shall be subject to the jurisdiction of courts located in India.
